Definitions
Terms and Conditions – means this document together with all annexes to it;
Website – means HomeHelp.lu website, available at https://www.homehelp.lu, being an online platform consisting of a set of elements typical for websites, as well as a range of services provided to users in a digital manner;
User – means a natural person, a legal person, or an organizational unit without legal capacity utilizing the Website in any way or form;
Registered User – means a User who has registered on the Website and created his or her unique profile secured with a password;
Administrator – means an entity managing and maintaining the HomeHelp website, also being the owner of the Website;
Author – means the owner or a given material or a person with the unlimited right to provide the Administrator with such a material to be published on the Website. By providing the Administrator with the material in question, the Author claims that he or she accepts those Terms and Conditions and that he or she has familiarized himself or herself with them;
Material – means a piece of information to be published on the Website.
- 1. GENERAL CONSIDERATIONS
- Those Terms and Conditions shall govern the principles of using the HomeHelp.lu website.
- Website in question shall be informational and promotional in character.
- Each User taking advantage of the Website shall claim that he or she has familiarized himself or herself with those Terms and Conditions, as well as accepts their provisions. Users below 18 shall declare that they have been allowed by their supervisors to use the Website.
- Website in question shall be an online portal publishing proprietary materials, as well as information and materials made available by third parties and organizations cooperating with the Website. Materials published on the Website shall be informational in character.
- 2. RIGHTS AND OBLIGATIONS OF USERS
- User shall be granted the right to publish and view materials available within the scope of the Website.
- User shall agree to utilize any information obtained for commercial purposes.
- It shall be strictly forbidden to publish materials, comments, and chunks of texts that may include statements punishable by law, breaching social norms, and violating rights of third parties, especially copyrights and personal interests. It shall be taken into account that materials published by the Users on the Website do not reflect views and opinions of the Administration of the Website.
- Users shall not utilize the Website and its functions for other purposes than they were intended to be used.
- User shall take advantage of all the pieces of information available on the Website at his or her own risk and on his or her own initiative.
- User shall claim that he or she agrees to use materials available on the website at his or her own risk. The HomeHelp.lu Website Administration shall not be held responsible for any damages caused by such actions.
- Use of the Website shall be limited by the provisions of legal acts of Luxemburg and by widely accepted regulations relating to all Internet users, aimed at the protection of their rights and the rights of third parties.
- User shall claim that he or she is in the holder of proper rights and licenses to materials published on the Website. The Administrator shall be granted the right to provide services and allow the User to take advantage of the Website after prior validating the legality of the materials to be published.
- User’s account and materials published by him or her can be deleted from the Website if the User performs actions that can be harmful for the Administration or breaches the provisions of those Terms and Conditions, especially – if he or she uses the Website for a purpose it is not intended to be used for.
- User’s account and materials published by him or her can be deleted from the Website without any justification if the Administrator considers such an action to be necessary.
- Registered User can, at any point, delete his or her account by sending a proper message to the Administration via the following e-mail: contact@homehelp.lu or via the available contact form. The Administrator shall do its best to delete the account as soon as possible. Nevertheless, the Administrator shall reserve the right to delete the account within 30 days from the moment of request collection.
- User shall be solely responsible for using his or her account.
- Registered User can, at any time, update his or her data or modify his or her materials by logging in to the website. An unregistered User shall receive an e-mail message with guidelines as to how to modify or delete published materials.
- All materials published by the User are available on the website for an indefinite period of time and do not have an expiry date. If a given material is out of date, the User shall be obliged to modify or delete it in order for it to be accurate.
- Administrator shall reserve the right to delete materials that are published in a language different than: English, French, German, or Luxembourgish.
- 3. RIGHTS AND OBLIGATIONS OF THE ADMINISTRATOR
- Administrator of the Website shall not be held responsible for any outcomes of using information available on the Website, especially – for decisions made basing on them.
- Administrator shall do its best to ensure the proper functioning of the Website.
- Administrator shall not guarantee fault-free and constant operation of the Website and shall not be held accountable for any damages caused by its malfunctions.
- Administrator shall reserve the right to breaks in operation of the website in order to perform malfunction or repair-related undertakings without prior informing Users about said fact and without specifying the duration of such breaks.
- Administrator shall reserve the right to: edit, shorten, or delete materials which are illegal, obscene, abusive, or in any other way breach established social norms.
- Administrator shall claim that materials being parts of the website are collected and edited with due diligence in order to ensure their accuracy, validity, and integrity. Nevertheless, the Administrator shall not be held responsible for their content. The Administrator shall not be held accountable for materials provided and published by the Users.
- Administrator shall not be held accountable for the validity of materials published on the Website, outcomes of their use by the Users, information obtained by taking advantage of the Website, and for decisions made by Users as a result to referring to them.
- Administrator shall not be, by any means, held responsible for damages caused as a result of providing invalid or incomplete information by the User.
- Administrator shall not be held accountable for undertakings performed by third parties, as well as for damages caused by the malfunction of User’s computer or the corruption of his or her data during the use or in relation to using the Website.
- Administrator shall not be held accountable for third parties gaining access to User’s password.
- Administrator shall reserve the right to modify, remove, suspend, or terminate any function of feature of the Website at any time, without informing the Users about the said fact.
- Administrator shall have the right to make amendments to the content of this Website, modify it, or terminate or suspend any of its elements without informing the Users about the said fact.
- Administrator shall reserve the right to:
- remove materials from the Website without any notification in the case of User’s breaching the provisions of those Terms and Conditions, applicable law regulations, good manners, religious beliefs, and rights of third parties
- block Registered User’s profile together with published materials for the breach of those Terms and Conditions or applicable law regulations
- discontinue providing services within the framework of the Website, after prior informing Users about the said fact
- publish advertisements or other materials promoting own goods and services, as well as those of third parties within the Website.
- Material copyrights to all the materials published within the Website shall be granted to the Administrator or to entities it has concluded proper agreements.
- Personal and material copyrights to materials specified in point 1 shall be legally protected.
- It shall be forbidden to utilize materials published within the Website by other Registered Users.
- Any form of using, copying, and disclosing materials published within the Website shall be preceded by being granted an explicit permission of the Administrator.
- While registering on the Website, the User shall agree for his personal data to be collected and processed by the Administrator.
- By creating a profile on the HomeHelp.lu Website, the User shall also agree to the presentation of those personal pieces of information in accordance with default settings of the Website.
- Personal data of the Users shall be taken advantage of by the Administrator to provide its services properly, predominantly – to provide the Users with content, communicates, and services that relate to the topic of the Website. The Administration of the Website shall not breach the right to privacy and personal data protection, as well as complies with the applicable law regulations.
- Users taking advantage of tools available within the Website to publish materials shall be asked to voluntarily publish personal data about them, including their place of residence, country of residence, e-mail address, native language, and experience. They will be visible to all individuals visiting the Website and therefore – are not covered by the Privacy Policy regulations.
- Administrator shall not disclose personal data of Users to institutions or third parties without the explicit consent of the User. The Administrator shall be authorized to provide such pieces of information to legally authorized bodies only.
- User shall have the right to check, modify, supplement, or delete personal information relating to him or her.
- Administrator shall resort to utilizing Cookie files as well in order to adjust the content and services provided within the HomeHelp.lu website to the requirements of the Users. Cookie files shall be saved on personal computers of the Users. Information included in them shall be available to the server after each and every connection with the device in question. Furthermore, Cookie files provide the Administration with statistical data on User behavior and willingness to utilize certain subsections of it. The User shall have the right to disable Cookie files in his or her browsing software. The Administration of the website also informs that it shall not be responsible for saving Cookie files by other website, to which the User may be redirected by clicking links available on the Website.
- Those Terms and Conditions shall constitute an integral part of the Agreement concluded with the User and shall enter into force after their publication on the Website.
- Administration shall reserve the right to introduce amendments to those Terms and Conditions. All amendments shall enter into force after the specified period of time, no sooner than after 2 days from their publication on the Website.
- To all issues not governed by those Terms and Conditions, applicable law regulations shall apply.
